 Conditions and Reasons

The projected tandem form of development (by having the access drive to the fore of Fairfields) would result in the proposed dwelling having an unsatisfactory relationship with the existing dwelling and it would have an adverse impact on the amenity of neighbouring residents, by reason of noise and disturbance from the use of the access drive. The proposal is therefore contrary to Policy D16 of Sedgemoor District Core Strategy.

The site lies outside of any identified settlement boundary where development is strictly controlled for the benefit of all. The proposed new dwelling will not maintain or enhance the environment, will be in an unsustainable location and will foster the growth in the need to travel nor will it benefit economic activity. The proposal is therefore contrary to Policies S1, S3 and P6 of the Sedgemoor District Core Strategy.

The site lies within flood zone 3 which is land at the greatest risk of flooding and no sequential or exception tests have been submitted. It is considered that there is land within the district that would be in a lower flood zone which would be sequentially preferable to this site and therefore the proposal fails the sequential test. As the sequential test is not passed there is no need to take the exception test. The proposal therefore does not comply with advice contained within the Technical Guidance to the National Planning Policy Framework and Policy D1 of the Sedgemoor District Core Strategy.
