 Conditions and Reasons

The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.

Any features such as rubble piles which potentially afford resting places for reptiles will be dismantled by hand by a suitably qualified ecologist between April and October and any individuals found translocated to an appropriate location prior to works commencing on site. Reason: In the interests of ecology.

A reptile survey should be carried out prior to works commencing and the results reported to the local planning authority. If reptiles are found then a detailed mitigation plan should be submitted and approved in writing by the local planing authority. Mitigation to be carried out as approved. Reason: In the interests of ecology.

No vegetative clearance work shall be carried out in the bird nesting season, which is approximately between March and August. If not possible a survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until the chicks have fledged. If nesting birds are found then a detailed mitigation plan should be submitted and approved in writing by the local planing authority. Mitigation to be carried out as approved. Three artificial swift nest boxes and two house sparrow terraces, of the Schwegler type of similar, will be installed on new buildings and maintained. The locations of these sites will be submitted to and agreed by Sedgemoor District Council prior to construction commencing on site. A letter confirming their installation will be submitted by the applicant's consultant ecologists. Reason: In the interests of ecology

Before the development hereby permitted is commenced details of the proposed foul and surface water drainage systems, and of the piping and filling of any ditches, shall be approved in writing by the local planning authority. Reason: In the interests of amenity.

No construction work, other than completely internal fitting out, shall take place outside the hours 07:00 to 18:00 Mondays to Fridays, 07:00 to 13:00 on Saturdays, with the exception of specific works which shall have been agreed in advance and in writing by the local planning authority and shall include details of the task, the date and duration of works and there shall be no working on Sundays and bank holidays. Reason: In the interests of neighbours amenity.

During the construction phase any external lighting must only directly illuminate the application site. Reason: To safeguard residents from obtrusive light

An adequate water supply shall be provided on site and maintained at all times. Where necessary or at the direction of the Local Authority, it shall be used to provide adequate dust suppression and minimise fugitive dust emissions from the development site. Reason: To safeguard local residents from dust nuisance.

Development shall not begin until a scheme to deal with contamination of the site has been submitted to and approved in writing by the local planning authority.

The above scheme shall include an investigation and assessment to identify the extent of contamination and the measures to be taken to avoid risk to the public/buildings/environment when the site is developed.

Development shall not commence until the measures approved in the scheme have been implemented.

The proposed access shall be constructed in accordance with details shown on the submitted plan, Drawing No. 068/002, and shall be available for use before occupation.  Once constructed the access shall be maintained thereafter in that condition at all times. Reason: In the interests of highway safety

The proposed estate roads, footways, footpaths, cycleways, bus stops/bus lay-bys, verges, junctions, street lighting, sewers, drains, retaining walls, service routes, surface water outfall, vehicle overhang margins, embankments, visibility splays, accesses, carriageway gradients, drive gradients, car, motorcycle and cycle parking, street furniture and tactile paving shall be constructed, laid out and maintained in accordance with details to be approved by the Local Planning Authority in writing before their construction begins.  For this purpose, plans and sections, indicating as appropriate, the design, layout, levels, gradients, materials, method of construction and proposals for future maintenance shall be submitted to the Local Planning Authority. Reason: In the interests of highway safety.

The area allocated for parking and turning on the submitted plan, Drawing No. 068/002, shall be kept clear of obstruction and shall not be used other than for parking and turning of vehicles in connection with the development hereby permitted. Reason: In the interests of highway safety.

Prior to the commencement of the development the tree protection fencing and ground protection measures will be installed under the supervision of a qualified arboricultural consultant and in accordance with the submitted Arboricultural Impact Assessment and Tree Protection Plan prepared by Treework Environmental Practice. No materials or plant shall be stored within the defined root protection area. No builders huts shall be placed, fires lit, liquids tipped, and rubbish dumped within this area. No underground services shall be located within the root protection area. Reason : To ensure that the protected lime tree (T1) is adequately protected for the duration of the development.
